We continue the discussion about COVID-19 related issues. We consider how the issue of 'urgency' is interpreted, and at which point it cannot be relied upon anymore. Also, how are 'regular' procurements (meaning not healthcare-related) affected by the circumstances of COVID-19? We discuss how regular procurements that are still to be launched, procurements that are currently in the mids of the process, or procurement contracts that have already been awarded, are affected and what kind of assistance can be found in the legal interpretation of the public procurement rules. For the happy, fun dessert time, we chat about the role of mentorship and our ambition to be mentors for our students.

Veel aanbestedingen worden ingezet als instrument om duurzaam en sociale veranderingen teweeg te brengen. Maar is dat verplicht? Of is het alleen maar een mogelijkheid? Over dit onderwerp spreekt Bob Rietjens (About Law podcast) met mij, mede naar aanleiding van een onderzoek dat ik uitvoerde met mr. Gerrieke Bouwman dat inmiddels is gepubliceerd in PPLR.
Voor de organisatie van publieke taken beschikt de overheid over meerdere juridische instrumenten. Het juridische onderscheid tussen subsidies en overheidsopdrachten is echter vaak niet duidelijk, en zorgt voor problemen in de rechtspraktijk. Ik spreek over dit thema en over prijsvragen met mr. Het corona virus heeft ook een impact op de aanbestedingswereld en de professionals die met het aanbestedingsrecht werken. Ik spreek met mr. Matanja Pinto over de kernvraag welke ruimte het aanbestedingsrecht biedt om goed om te gaan met deze veranderde – en nog steeds veranderende – omstandigheden tijdens deze pandemie.
BIM, Bimmen, Building Information Modellingen. Het wordt al een tijdje aangekondigd als de toekomst voor samenwerking in de bouw. Binnen aanbestedingen kan het een rol spelen in de vraagspecificatie, de contractvoorwaarden, en de gunning. Ik spreek met mr. dr. Evelien Bruggeman over de vraag is hoe dat precies past binnen het aanbestedingsrecht.
Het clusteren van opdrachten. Het MKB zou te weinig toegang krijgen tot aanbestedingen doordat te grote opdrachten in de markt gezet worden. Ook zou het schorten aan de handhaving van het clusterverbod en het splitsingsgebod uit artikel 1.5 Awet 2012. Ik spreek met mr. Georg Huith over de stevige discussie die er speelt in de praktijk en politiek.
